Definitions

“Toolbee” refers to Nitsan Simantov, his companies, employees, associates and partners.

“Contest” refers to Toolbee contests that are based on skill, not chance or random selection.

“Participant” or “you” refer to an eligible person who takes part in the contest by performing the required actions to enter.

“Entry” or “entries” refer to the instance or instances of performing the actions required to take part in the contest. Each entry gives you one chance to win the prize.

“Promotion” and “promotions” refer to public communications or advertisements created by Toolbee, for example, but not limited to, a post on a social media website or an email newsletter page.

“prize” refers to the item given to the winner free of charge, as specified in these terms.

General

This is a skill contest. the winner will be chosen by Toolbee based on their answer(s). There is no random selection or luck involved.

These terms, conditions and rules apply to the specific promotion or contests dated in this page. By entering the contest, you affirm that you have read and accepted the terms and rules written on this page.

Any other items (such as tools, electronics, machines, etc.) shown in photos are for illustration only, and are not included in the contest prizes.

Toolbee reserves the right to make changes to this contest, providing that it does not take away from the people who have already entered. For example, but not limited to, adding more prizes and allowing more time for these additional prizes to be won.

Entry

No purchase needed to enter. 

Purchasing from Toolbee does not improve your chances of winning.

Toolbee cannot be held responsible for entries that are not received or not seen due to technical errors or other difficulties or errors of any kind.

Joining the emailing or SMS list does not enter you into the contest or improve your chances of winning.

Prize

The prizes are hand made (with a sewing machine), so it may have imperfections.

The prizes are awarded “as is” with no guarantees or warranties whatsoever.

There is no cash prize whatsoever. the prize is not swappable, transferable, assignable, or redeemable for cash. the only instance where the prize may be swapped for cash or another item is at Toolbee’s own discretion, and in such an instance where Toolbee chooses to award cash, it would never be more than the value of one Toolbee pouch of the type shown in the contest.

If any monetary value is stated in this document or in other promotional materials or in any other communication with Toolbee or the Participant, then this is the estimated store value of the prize. This is not a cash prize.

Toolbee has the absolute final say on prizes and winners and anything else related to the contest, as far as is permissible by law. 

This Contest may be promoted multiples times in multiple social media websites on the internet, in which case, Toolbee will link to the main Contest post, which will show or link to these terms, conditions and rules, and in such a case, it is stipulated that not every social media post is a new contest, but rather, they are multiple communications to promote the existing contest. the value or number of prizes or number of winners will not increase due to multiple links promoting the same contest. Only the specified number of items on this terms, conditions and rules page will be awarded.

Winner

The winner will be notified via the platform they posted on (Youtube, Facebook, etc.) and/or via the email or phone number they used to sign up on this page.

Should the winner be found to be ineligible then they will be disqualified and another person will be selected instead.

Taxes and import

The prize will be shipped from Israel. Any and all federal, state, and/or local taxes, fees or other costs of any kind are the responsibility and liability of the winner.

Contest operation

If for any reason this contest is not capable of running as planned, or is delayed, or is prevented from completion, then Toolbee will decide on the best course of action to continue. For example, if there is a computer problem, the contest will likely resume the next day that is possible. If it is not possible to continue the contest for technical reasons, Toolbee may, at its own discretion, start the contest again.

Disqualification

Toolbee reserves the right to refuse awarding the prize. For example, but not limited to, suspicion of unfair or illegal activity on behalf of the participant.

The use of any device or website or service to automate the entry process is prohibited.

Third party websites

Toolbee contests are a promotion by Nitsan Simantov, the person who makes the Toolbee products.

Any contest entries on youTube must comply with their own Community Guidelines. Entries which are found to not comply with these terms will be disqualified. Youtube is not a sponsor of any Toolbee contests.

This promotion is in no way sponsored, endorsed or administered by, or associated with, Youtube, Facebook, Instagram, Tumblr, Pinterest or Twitter.

Open to residents of:

Argentina, Australia, Austria, Belgium, Brazil, Canada (excluding Quebec), Chile, Columbia, Czech Republic, Denmark, Finland, France, Hungary, India, Ireland, Japan, Luxembourg, Mexico, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Russia, Singapore, South Korea, Spain, Sweden, Thailand, Philippines, Ukraine, United Kingdom, United States. Void where prohibited.

Important note: For legal reasons, we cannot include people outside of these countries in the promotion. However, if you are a resident in one of the countries listed above, I would be happy to ship the prizes to anywhere you want via regular post (for example if you want to send the prize as a gift to a friend who lives in another country) – except China, Hong Kong, Bangladesh, Indonesia, Macao, and package redirection centers. I do not ship to these.

Privacy

The participant grants Toolbee permission to show their entry in Toolbee’s promotional material or public communications.

All information submitted, such as, but not limited to, the participant’s name and email address, is subject to the Toolbee’s Privacy Policy which can be found here. This contest may be run through the services of third party apps. The participant’s private personal details, such as their email address, will not be given to any third parties, with the exception of using third party tools or services required for Toolbee’s operations such as, but not limited to, sending out email promotions, or if Toolbee is required by law to provide personal details. For example, but not limited to, Mailchimp.com. Toolbee uses the services of Mailchimp for its email marketing. When you sign up, your data is sent to Mailchimp. you can read Mailchimp’s own privacy policy in this link.

The Participant’s personal details, such as, but not limited to, their name and email address, may be used to send the Participant emails, including promotional emails, if they have signed up for the newsletter. the Participant may unsubscribe from the email list at any time by following the link at the bottom of each email, or by replying to the email and requesting to be removed.

Limit of liability

Use Toolbee products at your own risk. Toolbee does not guarantee protection of your tools or equipment, and it does not guarantee anything else whatsoever. It is your responsibility to take care of your own tools and equipment.

The participant releases and waives any claims they may have against Toolbee or Nitsan Simantov for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including, but not limited to, attorney’s fees) resulting from acceptance, use, or misuse of the prize or parts thereof, or participation in the contest, or use of the Toolbee.co website. By entering the contest, the participant releases Toolbee and Nitsan Simantov against any claims and liabilities arising in any way from this contest or from the use of Toolbee products or the use of Toolbee websites or use of the prize.

By entering this contest you agree to absolve Instagram, Facebook, Twitter, youtube and Toolbee of any responsibility or liability whatsoever with regards to Toolbee contests.

By entering the contest, you agree to release and hold harmless Nitsan Simantov and Toolbee and and its advertising agencies, partners, successors, assigns, employees, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from, but not limited to: (i) participation in the contest and/or acceptance, possession, use, or misuse of the prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the contest; (v) electronic or human error in the administration of the contest or the processing of entries.

Legal

This contest is void where prohibited.

You are responsible for the content you post. If the content of your entry, such as, but not limited to, posting a photograph, is claimed by a third party to constitute infringement of any kind, such as, but not limited to, copyright or proprietary or intellectual rights infringements, of any third party, you shall, at your sole expense, defend or settle against such claims.

Toolbee reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Toolbee’s control corrupt or affect the administration, security, fairness, or proper conduct of the contest. In such a case, Toolbee may select the winning entry from all eligible entries received prior to and/or after (if appropriate) the action taken by Toolbee.

Toolbee reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the contest or website or violates these terms & conditions.

Toolbee reserves the right, in its sole discretion, to void entries for any reason, for the purpose of maintaining the integrity of the contest, including, but not limited to: multiple entries in excess of the allowed number as set by these rules, or the use of bots, macros, scripts, or other technical means for entering.

This contest shall be governed by the laws of the state of Israel, without respect to conflict law of doctrines. By entering the contest, participants hereby submit to the jurisdiction and venue of these laws and courts, and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. As a condition of participating in this contest, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the state of Israel. Further, in any such dispute, under no circumstances shall participants be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including attorney’s fees. Participant further waives all rights to have damages multiplied or increased.

If any part of this document is deemed unenforceable by law, the rest of the document shall remain in full effect.
